**Terms and Conditions of Participation**

§ 1 Organizer

§ 2 Participants

1. Participants register for the rally as part of individual teams. Each participant must be at least 18 years old at the start of the rally.

2. At least one driver from each team must hold a valid driver's license. Only this driver may operate the vehicle during the rally, even on closed tracks. If multiple team members hold a valid driver’s license, driver changes are allowed and encouraged. The respective licenses must be presented to the organizers upon request.

3. Only participants who are fully fit to drive may take part in the rally. Any impairment of driving ability, particularly due to alcohol, drugs, or medication, will result in exclusion from the rally.

4. Each participant agrees to follow the instructions of the staff. Severe violations of these instructions may result in exclusion from the rally. In such cases, there is no entitlement to a refund of the participation fee.

5. By registering, all participants agree to comply with applicable traffic regulations and the rules for closed tracks during the entire event. Each participant is personally responsible for any fines, penalties, or other sanctions imposed on them.

§ 3 Vehicles

1. Each participant agrees to only participate with road-legal vehicles.

2. The required age of the vehicle is specified in the respective conditions of each rally, as the requirements may vary.

3. Since the event largely takes place on public roads, only vehicles with valid registration (standard license plates, H-license plates, red 07-number) that are in a roadworthy and legal condition may participate. Vehicles with temporary plates or a red 06-number are not permitted. Foreign license plates are allowed, provided the vehicles comply with the requirements of the German Road Traffic Licensing Regulations (StVZO).

§ 4 Participation Fee / Content / Contract Conclusion

Baltic Sea Circle, European Mountain Summit, European 5000, Knights of the Island, Balkan Express, Deutschland Rally, Jupiter's Flash, Viking Sun, Viking Snow, The Deutschland Rally

1. The registration fee for the Baltic Sea Circle, European 5000, Balkan Express, and Jupiter’s Flash is €1,500 for a two-person team. Each additional team member incurs a start fee of €300. Additional team members may be registered up to one month before the rally starts.

2. The registration fee for Knights of the Island and Viking Snow is €1,500 for a two-person team. Each additional team member incurs a start fee of €300. Additional team members may be registered up to one month before the rally starts.

3. The registration fee for the Baltic Sea Circle Winter Edition is €1,790 for a two-person team. Each additional team member incurs a start fee of €400. Additional team members may be registered up to one month before the rally starts.

4. The registration fee for the European Mountain Summit, Viking Sun, and The Deutschland Rally is €1,200 for a two-person team. Each additional team member incurs a start fee of €300. Additional team members may be registered up to one month before the rally starts.

5. The number of team members is limited to the number of seats legally permitted in the chosen vehicle (e.g., a vehicle with five seats may have a maximum of five team members).

6. The registration fee includes the following services:
a) Official rally start and pre-start meeting the day before
b) Finish line event with final celebration, award ceremony, and SAC finisher certificate
c) Rally events at extraordinary locations along the route with overnight accommodations
d) Rally kit, including official rally vehicle branding, logos, starting numbers, rally t-shirts, stickers, and merchandise. The rally kit will be sent to the teams two months before the start.
e) Roadbook: Each team will receive tasks in their roadbook to deepen their rally experience. The roadbook will be handed out at the start.
f) SAC Track: The official S.A.C Live Tracking App
g) Support for organization and planning
h) Team page on the S.A.C website
i) Press coverage of the rally
j) SAC will be the point of contact for questions and issues before and during the rally.

7. The participation fee does not include:
a) Accommodations
b) Meals
c) Drinks
d) Technical support (this must be organized by the team).

8. By submitting the registration, the prospective participant makes a binding offer to the organizer for the conclusion of a service contract in accordance with § 611 of the German Civil Code (BGB). The registration is only valid if the participation fee has been successfully transferred to the SAC registration account. Once the registration process is completed and the participation fee is received, the team will receive a confirmation of registration, participation terms, and cancellation policy from the organizer via email. Upon receipt of these documents, the service contract between the parties is concluded.

9. The participation fee will not be refunded in case of unnotified non-participation.

10. The participation fee will not be refunded if the rally cannot take place due to force majeure, such as natural disasters, civil unrest, or explicit travel warnings from the German Foreign Office.

11. The number of participating teams is limited. The decision to accept a registration, even if all conditions are met, is at the sole discretion of the organizer.

Atlantic Pacific Ocean Drive

1. The registration fee is €1,000 for a two-person team. Each additional team member incurs a start fee of €300. Additional team members may be registered up to two months before the rally starts.

2. The number of team members is limited to the number of seats legally permitted in the chosen vehicle (e.g., a vehicle with five seats may have a maximum of five team members).

3. The registration fee includes the following services:
a) Official rally start and pre-start meeting the day before
b) Finish line event with SAC finisher certificate
c) "Good-Bye Europe" rally party in an extraordinary location with overnight accommodations
d) Final event and award ceremony in Germany
e) Rally kit, including official rally vehicle branding, logos, starting numbers, rally t-shirts, stickers, and merchandise. The rally kit will be sent to the teams one month before the start.
f) Roadbook: Each team will receive tasks in their roadbook to deepen their rally experience. The roadbook will be handed out at the start.
g) SAC Track: The official S.A.C Live Tracking App
h) Support for organization and planning
i) Team page on the S.A.C website
j) Press coverage of the rally
k) SAC will be the point of contact for questions and issues before and during the rally.

4. The participation fee does not include:

§ 6 Participant Withdrawal

1. In the event of a withdrawal by the participant, the participation fees will not be refunded. This is due to the fact that chargeable services are incurred by the organizer immediately after registration, including those specified in § 4(6) of these Terms of Participation, as well as additional services such as event location rentals, press work, etc. The participant expressly agrees to this procedure upon registration.

2. The provisions regarding statutory withdrawal and its consequences remain unaffected by the above regulation.

The participant expressly agrees that the organizer may begin performing its services before the end of the withdrawal period.

Even in the case of an effective withdrawal, the participant is obligated to pay for the value of the services rendered up to the point of withdrawal.

The participant expressly agrees to this procedure upon registration.

3. Until the start of the event, the participating team may transfer its place to third parties after consultation with the organizer. This requires the organizer’s express written approval. Any additional costs incurred will be borne by the team originally eligible to participate.

§ 7 Organizer Withdrawal and Termination

The organizer may withdraw from the contract before the event starts, or terminate the contract after it has begun, in the following cases:

- Up to four weeks before the rally start:
If the minimum number of 20 teams is not met. The organizer is required to notify the participants immediately if this condition arises and to issue the withdrawal statement promptly. The participants will receive a refund of their participation fees immediately.

- Without notice:
If a participant significantly disrupts the event, behaves in an unsportsmanlike manner towards other participants, or behaves in such a manner that makes immediate termination of the contract justified. In such a case, the organizer retains the right to the participation fee but must credit any saved expenses and any benefits obtained from reallocating unused services, including amounts received from service providers.

§ 8 Cancellation Due to Extraordinary Circumstances

1. If the event becomes significantly more difficult, dangerous, or impaired due to unforeseeable extraordinary circumstances at the time the contract

 was concluded, the organizer may terminate the contract. This particularly applies in cases of denied permits by authorities, permits with excessive conditions, natural events, unrest, or current terrorist threats.

2. If the contract is terminated, the organizer is entitled to claim reasonable compensation for services already rendered or services that still need to be rendered to conclude the event. If such a case occurs, no claims can be made by the participants against the organizer.

3. Any additional costs incurred due to the cancellation of the event after it has begun will be borne by the participant.

§ 9 Unused Services

If a participant does not take advantage of certain services offered by the organizer, there is no entitlement to a partial or full refund of the participation fees.

§ 10 Responsibility and Liability of the Organizer

1. The organizer reserves the right to make necessary changes and additions to the event’s announcement, program, and schedule, or to cancel the event if extraordinary circumstances require it, without accepting any liability for damages. Intent and gross negligence are excluded from this.

2. In case of violations that disrupt the smooth running of the event or endanger the safety of other participants, the organizer is entitled to exclude the offending participant from the event at any time. An exclusion may also be pronounced if a participant violates the regulations or general sportsmanship rules during the event. This especially applies to violations of these terms of participation.

3. The organizer is liable within the scope of its duty of care for the diligent preparation of the event and the proper provision of the contractual services.

§ 11 Participant Responsibility, Limitations, and Exclusions of Liability

1. Drivers and co-drivers agree to follow the instructions of the organizer, event management, and their representatives.

2. Each participant is required to take out travel health insurance, including repatriation, for the duration of the event. Proof of insurance must be provided to the organizer in writing.

3. Participants acknowledge that road conditions on secondary routes can be unpredictable and vary greatly. As gravel roads may be included, extra caution and appropriate speed must always be maintained to avoid damage to vehicles and injury to persons.

4. The organizer assumes no liability for health risks associated with participation in the event. Each participant is responsible for ensuring that they are fit to participate, which may involve consulting a physician and providing proof to the organizer upon request.

5. The organizer is not liable for the vehicles used or any parts thereof. The organizer also assumes no liability for lost valuables or equipment. Additionally, the organizer is not liable for any damages to vehicles caused by improper attachment or removal of the rally kit.

6. The organizer is not liable for reductions in service resulting from the participant being legally or officially prohibited from participating in the event.

7. Each participant acknowledges and understands that participation in the rally entails potential dangers. Driving long distances in unfamiliar environments increases the risk of accidents, which can lead to serious injury or death. Participants (drivers, co-drivers) take part in the rally at their own risk. They are solely responsible for all civil and criminal damages caused by them or the vehicle they use.

8. Participants hereby waive any claims for damages arising from the event against:
a. Their own driver or co-driver
b. Other participants (drivers, co-drivers)
c. The organizer and its employees
d. Service providers and any other persons associated with the organization of the event.

This liability waiver does not apply to damages resulting from injury to life, body, or health, or other damages caused by willful misconduct or gross negligence by the released parties. Nor does it apply to damages caused by the breach of essential contractual obligations (i.e., obligations that are necessary for the proper execution of the contract and whose compliance can generally be relied upon). For damages caused by slight negligence in the breach of such essential contractual obligations, liability is limited to the typical, foreseeable damage.

The waiver applies to claims of any legal nature, particularly for damages claims arising from contractual or non-contractual liability and for damages claims based on tort. Implied liability exclusions remain unaffected by the aforementioned liability waiver.

9. Implied liability exclusions remain unaffected by the above liability clauses.

10. Participants' claims for damages due to defects expire one year after the delivery of the service.

11. The organizer is not liable for traffic violations or customs-related incidents involving participants.

12. Participants must regularly check and follow up-to-date travel and safety advisories for each country. Difficulties crossing borders in certain areas cannot be ruled out. The organizer is not liable or responsible for border closures or any resulting inability to cross borders.

§ 12 Application of the Participation Terms

1. The organizer is responsible for enforcing these terms during the rally.

2. Any cases not covered by these terms will be reviewed by the organizer and decided at their discretion.

§ 13 Media Coverage

1. The team confirms that all protection and copyright rights related to the rally, such as name, logo, format, film, and photographic material of the rally, exclusively belong to the organizer.

2. By registering and participating in the rally, all team members agree, on behalf of themselves and their sponsors, that their names, photos, videos, vehicles, and other related materials may be used and distributed in digital media, print media, and television.

§ 14 Duty to Cooperate

1. Participants are required to cooperate in resolving any performance issues that arise, within the scope of legal regulations, to avoid or minimize potential damages.

2. Participants are specifically required to report any complaints immediately to the rally management. The rally management is authorized to provide assistance where possible.

§ 15 Exclusion of Claims and Statute of Limitations

1. Participants must submit claims regarding non-contractual services within one month after the contractual end date of the event to the organizer.

2. After the deadline, participants may only assert claims if they were prevented from meeting the deadline through no fault of their own.

3. Participants' claims against the organizer, regardless of the legal grounds, expire one year after the contractual end of the event. If a participant has made a claim, the limitation period is suspended until the day the organizer rejects the claim in writing.

§ 16 Entry, Passport, Visa, and Health Regulations

1. Participants are responsible for complying with all regulations and laws concerning entry, passport, visa, and health requirements relevant to their participation in the event.

2. Any disadvantages resulting from non-compliance will be borne by the participant.

3. The organizer assumes no liability for claims derived from non-compliance with these regulations.

§ 17 Charity

1. Each participating team collects donations for the selected charity projects chosen by the organizer. The specific donation requirements for each rally are provided in the relevant conditions, as these may vary between rallies.

2. The selected charity partners of the organizer can be found on the respective rally’s website.

3. Collected donations go directly to the carefully selected charity partners of the organizer. Donations may be collected from the time of registration until the end of the rally.

4. Donations for the organizer’s charity partners will only be collected via the designated online platforms.

§ 18 Invalidity of Individual Provisions

Should any provisions of these terms be or become legally invalid, this does not affect the validity of the remaining provisions. In such a case, the parties are obligated to replace the invalid provision with a legally permissible and compatible regulation that comes closest to the economic content of the invalid provision.

§ 19 Data Collection

1. The personal data provided by participants during registration will be stored and processed solely for the purpose of executing and managing the event. This also applies to the data required for payment processing (§ 28 of the German Federal Data Protection Act). By registering, the participant consents to the storage of data for this purpose.

2. The participant agrees that their personal data (name and address) may be shared for the purpose of sending photos taken of the participant during the rally, such as at the start or finish, by a company contracted by the organizer. However, this does not imply that the participant agrees to purchase such a photo.

3. The participant agrees that personal data collected (such as first and last name, place of residence, year of birth, or age, team name, and start number) may be used for team or driver presentation in all event-related print and electronic media, including the internet.

4. Additionally, the participant agrees to the publication of the data mentioned in § 19(3) concerning the public display or announcement of results, such as participant or result lists.

5. Participants may object in writing to the sharing or publication of their personal data with the organizer.

§ 20 Miscellaneous

1. The contract is a service contract under § 611 BGB. Travel law does not apply. Sports law applies.

2. The underlying event is not a race or competition aimed at achieving the fastest time or highest speed over specific sections.

3. Teams may conduct their own marketing and search for sponsors in coordination with the organizer.

4. Official logo and start number stickers must be visibly attached to the doors and hood of the vehicle for the entire duration of the event.

5. Each team guarantees that neither the team nor any team member will make offensive or derogatory remarks or participate in any activities that may harm the reputation and image of the organizer, the rally, or its partners.

§ 21 Place of Performance and Jurisdiction

1. The place of performance is Hamburg.

2. The court of jurisdiction for all claims arising from this contractual relationship is the court with jurisdiction in Hamburg, as long as this is legally permissible.

Right of Withdrawal

Withdrawal Policy

You have the right to withdraw from your contract declaration within 14 days without giving any reason, by providing a clear statement of your decision. The withdrawal period starts after receiving this notification on a durable medium. To meet the withdrawal deadline, it is sufficient to send your statement of withdrawal before the withdrawal period ends. You may submit your statement of withdrawal via any durable medium (e.g., letter, fax, email) to:

Consequences of Withdrawal

In the event of a valid withdrawal, both parties are required to return any services received. You are obliged to pay compensation for services rendered up to the point of withdrawal if you were informed of this obligation and expressly agreed that we could begin providing the service before the withdrawal period ended. If a compensation obligation exists, you may still be required to fulfill contractual payment obligations for the period up to the point of withdrawal. Your right of withdrawal expires early if the contract is fully performed by both parties at your express request before you have exercised your right of withdrawal. Obligations to refund payments must be met within 30 days. The period begins for you when you send your withdrawal notice, and for us when we receive it.
